Own Miami (the “Site”) is operated by Innate Duty LLC (“we,” “us,” or “Own Miami”), 30 N Gould St, Ste N, Sheridan, WY 82801. By accessing or using the Site you agree to these Terms of Use and to our Privacy Policy. If you do not agree, do not use the Site. You must be at least 18 years old to use the Site.

Own Miami is a marketing and technology platform that helps consumers research Miami condominium buildings and listings and, if they choose, connect with licensed Florida real estate professionals. Innate Duty LLC is not a real estate brokerage, does not represent buyers or sellers, and does not provide real estate brokerage services. Nothing on the Site creates an agency, brokerage, fiduciary, or client relationship. Any such relationship is formed only through a separate written agreement between you and a licensed real estate professional or brokerage.

No affiliation. Own Miami and Innate Duty LLC are independent and are not affiliated with, endorsed by, or sponsored by any other company, team, or brokerage that uses a similar name (for example, any similarly named real estate team, brokerage, or social-media account). Any such similarity of name does not indicate any connection.

Compensation disclosure. When you choose to connect with a real estate professional through the Site, a licensed real estate brokerage or agent may receive a referral fee or a share of the commission from a resulting transaction — including the licensed Florida brokerage and agent affiliated with the operator of the Site. Innate Duty LLC is not a licensed real estate brokerage and is not paid real estate commissions; any transaction-based compensation is received only by a licensed brokerage or agent as permitted by Florida law. Because there is a financial incentive, being connected through the Site is not an endorsement or a recommendation to hire any particular professional — you are free to work with anyone you choose and should independently evaluate any professional before engaging them.

Listing data, market statistics, building descriptions, the Own Miami Building Score, price estimates, the mortgage/affordability estimator, and all other tools are provided for general informational purposes only. They are not an appraisal and do not constitute real estate, legal, tax, financial, mortgage, or investment advice. Estimates are automated approximations that may be inaccurate; square footage and measurements are approximate; and market figures are computed from MLS records that may contain errors or omissions. Verify all information independently and consult appropriate licensed professionals before making any decision.

This information is provided exclusively for consumers’ personal, non-commercial useto identify prospective properties they may be interested in purchasing, and may not be used for any other purpose.

You agree that you will not, and will not permit others to:

• copy, scrape, harvest, crawl, republish, redistribute, license, or resell any listing data, agent or office information, images, or statistics from the Site;
• use any listing, agent, or member information to build a database, to compile or publish agent or brokerage comparisons or rankings, or to solicit or market to real estate agents, brokers, buyers, sellers, or property owners;
• use automated means (bots, spiders, scripts) to access the Site, or circumvent any access, rate-limit, or security control; or
• use the Site or its data in any way that violates the MIAMI REALTORS® MLS Rules and Regulations, the IDX rules, applicable copyright, or any law.

You are responsible for the accuracy of the information you provide and for activity under your account. Do not use the Site to post unlawful, infringing, or harmful content; to impersonate others; to interfere with the Site’s operation; or for any unlawful or discriminatory purpose. We may suspend or terminate access that violates these Terms.

The Site’s design, original text, editorial content, the Own Miami Building Score methodology, and the Own Miami name and logo are owned by Innate Duty LLC or its licensors and are protected by intellectual-property laws. MLS listing content is owned by the Miami Association of REALTORS® and/or its Participants. You receive no license except the limited personal, non-commercial use described above.

Liens et services tiers

We are not responsible for third-party websites, professionals, brokerages, or services referenced or linked from the Site. Your dealings with them are solely between you and them.

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Site or its data are accurate, complete, current, or error-free.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

Indemnisation

You agree to indemnify and hold harmless Innate Duty LLC and its affiliates from any claim or demand arising out of your use of the Site or your violation of these Terms or any law.

Loi applicable et litiges

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. You agree that any dispute will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction.
